These Terms & Conditions ("Terms") govern your use of the website fourfive.in ("Website") and your purchase of products from Four.Five™, a brand owned and operated by Edge 2 Edge Brands Pvt. Ltd., a company incorporated under the Companies Act, 2013, having CIN U46491DL2026PTC464763 and registered office at 36-A Friends Colony East, New Delhi – 110065, India.

By accessing or using this Website, or by placing an order, you agree to be bound by these Terms. If you do not agree, please discontinue use of the Website.

2.1 About Four.Five

Four.Five is a hygiene and personal care brand. Our current product, the Active Hygiene Mist, is a cosmetic product as defined under the Drugs and Cosmetics Act, 1940, intended for external use as a freshness and odour-control mist for adults.

Four.Five™ is a trademark of Edge 2 Edge Brands Pvt. Ltd. (application pending registration).

2.2 Eligibility

By placing an order on this Website, you confirm that:

· You are at least 18 years of age, or are placing the order with the involvement and consent of a parent or legal guardian;

· The information you provide is accurate and complete;

· You have the legal capacity to enter into a binding contract under Indian law.

2.3 Account and Checkout

Guest checkout is available, and account creation is not mandatory to place an order. You are responsible for providing accurate shipping, contact, and order information at the time of checkout.

2.4 Product Information

We make every effort to ensure that product descriptions, images, and pricing displayed on the Website are accurate. However:

· Product packaging, formulation, or appearance may change without prior notice.

· Slight variations in product colour or scent batch-to-batch may occur due to the use of natural essential oils.

· All product descriptions on this Website refer to the product's cosmetic properties only. Four.Five products are not intended to diagnose, treat, cure, or prevent any disease or medical condition, and no claims to that effect are made or should be implied.

2.5 Pricing and Payment

· All prices displayed on the Website are in Indian Rupees (INR) and are inclusive of applicable GST. There are no hidden charges; the price shown at checkout is the final price payable, other than any shipping or COD fee, which is displayed separately before you confirm your order.

· Prices are subject to change without prior notice; however, the price applicable to your order is the price displayed and confirmed at the time you place your order.

· Promotional offers and discounts are valid only for the period specified and may be modified, extended, or withdrawn at our discretion.

· We currently accept payments via Razorpay (covering UPI, credit/debit cards, net banking, and supported wallets) and Cash on Delivery (COD), subject to the conditions specified in our Shipping Policy.

2.6 Order Confirmation and Contract Formation

Placing an order on the Website constitutes an offer to purchase. For prepaid orders, payment is authorised and captured at checkout through our payment gateway; however, a binding contract of sale is formed only upon our confirmation of your order via email, SMS, or WhatsApp (as applicable). We reserve the right to refuse or cancel any order, including in cases of pricing errors, suspected fraud, or unavailability of stock. If we decline or are unable to fulfil an order for which payment has already been captured, the full amount will be refunded to your original payment method, and no contract of sale shall be deemed to have been formed.

All content on this Website — including but not limited to the Four.Five™ brand name, logo, product photography, packaging design, graphics, text, and overall website design — is the exclusive property of Edge 2 Edge Brands Pvt. Ltd. and is protected under applicable Indian intellectual property laws. You may not copy, reproduce, distribute, or use any such content for commercial purposes without our prior written consent.

2.8 User-Generated Content

If you tag, mention, review, or otherwise share content related to Four.Five on social media (including Instagram) or submit testimonials to us, you grant Edge 2 Edge Brands Pvt. Ltd. a non-exclusive, royalty-free, worldwide right to repost, reproduce, and use such content for marketing and promotional purposes, with appropriate credit where reasonably possible. Where any such content has been created in exchange for a product, payment, or other incentive, we will disclose that material connection in accordance with the Advertising Standards Council of India (ASCI) Guidelines and applicable law.

2.9 Prohibited Use

You agree not to use this Website for any unlawful purpose, to transmit harmful code, to attempt unauthorised access to our systems, or to engage in any activity that disrupts the Website's functioning.

2.10 Limitation of Liability

To the maximum extent permitted under applicable law, Edge 2 Edge Brands Pvt. Ltd.'s aggregate liability arising out of or relating to any order placed on this Website shall not exceed the value of that order. We shall not be liable for any indirect, incidental, or consequential damages, except in cases involving gross negligence or wilful misconduct on our part.

Nothing in these Terms shall exclude or limit our liability for death or personal injury caused by our proven negligence, for fraud, or for any liability that cannot be excluded or limited under applicable law, including your statutory rights under the Consumer Protection Act, 2019.

The product is provided on an "as is" basis. While we take care in formulation, testing, and quality control, individual skin reactions can vary. Four.Five products are cosmetic products intended for external hygiene and freshness use only and are not intended to diagnose, treat, cure, or prevent any disease or medical condition. 2.12 Indemnity

You agree to indemnify and hold harmless Edge 2 Edge Brands Pvt. Ltd., its directors, and employees from any third-party claims, losses, or damages arising specifically from (a) your use of the product in a manner inconsistent with its stated instructions and warnings, (b) your infringement of our or any third party's intellectual property rights, (c) your unauthorised resale or commercial exploitation of the product, or (d) your unlawful use of the Website. This clause does not affect your rights as a consumer under applicable law.

2.13 Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India.

We encourage you to first contact us so that we may attempt to resolve any concern amicably.

For consumers: Nothing in these Terms affects your rights under the Consumer Protection Act, 2019. If you are a consumer, you retain the right to approach the appropriate Consumer Disputes Redressal Commission, and you are not required to submit your dispute to arbitration. Subject to your statutory rights, the courts at New Delhi shall have jurisdiction.

For commercial disputes: Any dispute arising out of or relating to these Terms in a business, vendor, supplier, reseller, or other non-consumer capacity that is not resolved amicably within 30 days shall be referred to and finally resolved by arbitration by a sole arbitrator, mutually appointed, in accordance with the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be New Delhi, and the proceedings shall be conducted in English.

2.14 Force Majeure

We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, epidemics or pandemics, government action or restrictions, strikes, courier or logistics disruptions, power or internet failures, or civil unrest.

2.15 Amendments

We reserve the right to update these Terms at any time. Continued use of the Website following any changes constitutes your acceptance of the revised Terms.
